CLAUSE: 1 FORMATION NAME AND SHORT TITLE.
This is a national federation consisting of Union formed
by Punjab Provincial Union, Sindh Provincial Union,
NWFP Provincial Union, Baluchistan Union, In view of
excellent remarkable services rendered by the Mr. Nazir
Ahmed Sadiqi, Mr. Syed Zia Ullah Azam President &
Secretary General of General Federation of Trade Unions.
Hereinafter be referred to as "G.F.T.U" short
title in this constitution.
CLAUSE: 2 UNION HEAD OFFICE ADDRESS.
The registered Head Office / Headquarter of the Federation
shall be at “QASIM PURA, RAILWAY ROAD, GUJRAT
50700 (PAKISTAN).” However sub offices at Provincial
level / District Level can be created / established
with the prior permission of the President and Secretary
General.
CLAUSE: 3 AIM AND OBJECTS.
The objects of the GFTU are as follows:-
(i) To promote the interests and improve the workings
of all its affiliated organizations.
(ii) To improve the conditions of employment of members
of affiliated organizations and to protect the interest
of affiliated organizations and their members.
(iii) To undertake all such acts as shall be considered
to be beneficial to the social and economic conditions
of workers.
(iv) To encourage the organization of all workers eligible
for membership of its affiliated organizations.
(v) To provide benefits for affiliated organizations
as laid down in the Rules and Constitution of the General
Federation of Trade Unions.
(vi) To provide all or any affiliated organization with
financial or other assistance.
(vii) To provide and make financial provisions for educational
facilities and instruction in accordance with any schemes
which may from time to time be approved by the Governing
Body.
(viii) To assist any affiliated organization either
financially or otherwise in any legal proceeding or
dispute or other matter or in the provision of legal
advice.
(a) to establish, maintain and develop a powerful and
effective national organization consisting of free and
democratic trade unions, independent of any external
domination and pledged to the task of promoting the
interests of working people throughout Pakistan and
enhancing the dignity of labour;
(b) to co-ordinate, direct and guide the activities
of regional federations, the affiliated industry-wise
unions and their industrial federations, in all matters
directly or indirectly affecting the workers;
(c) to preserve, secure, maintain and seek universal
recognition for the workers of Pakistan.
i) freedom of association;
ii) freedom of assembly;
iii) freedom of speech;
iv) freedom of press;
v) right of collective bargaining;
vi) right of strike or withdrawal of labour;
vii) right to decent work, human dignity and social
security; and
viii) equal rights and privileges in employment, irrespective
of race, colour, creed and sex;
(d) to undertake and coordinate the defense of the
free trade unions against any campaign aiming at their
destruction or at the restriction of their rights or
at the infiltration and subjugation of labour organization
by totalitarian or other anti-labour forces;
(e) to strive for the establishment of full employment;
the elimination of discrimination on grounds of race,
colour, sex, nationality or creed; the campaign aiming
at their destruction or at the restriction of their
rights or at the infiltration and subjugation of labour
organization by totalitarian or other anti-labour forces;
(e) to strive for the establishment of full employment;
the elimination of discrimination on grounds of race,
colour, sex, nationality or creed; the improvement of
working conditions; health and safety standards for
workers; the introduction, maintenance and extension
of social security for all; and raising standards of
living of peoples of Pakistan;
(f) to represent the free trade union movement in all
regional and international forums which exist or may
be set up to perform functions affecting the social
and economic conditions of working peoples and to further
the implementation of their decisions whenever desirable;
(g) to ensure the integration of women in trade union
organizations and actively promote gender equality in
activities and decision-making at all levels;
(h) to strive for elimination of child labour and all
forms of forced/ bonded labour;
(i) to endeavor to strengthen international solidarity
amongst the working men and women of the world and in
particular to actively co-operate with the workers of
other countries to defend and promote fundamental and
democratic rights of workers and other common interests
and to support and co-operate with national, regional
and international organizations of workers in their
struggle against all forms and kinds of exploitation
and oppression and to create solidarity among national,
regional and international level workers’ organizations;
(j) to defend and promote at the national, regional
and international level the economic, social and occupational
interests of all workers;
(k) to promote peace and security at the national,
regional and international level for the human welfare,
particularly for the working men and women;
(l) to seek universal recognition and enforcement of
the trade union rights including the rights of freedom
of association and to bargain collectively;
(m) to represent Pakistani workers at national, regional
and international forums;
(n) to furnish to all its affiliated units and the
constituent regional federations information on the
economy, employment, labour legislations, wages and
working conditions at workplaces in different parts
of the country, as well as at the regional and global
level;
(o) to endeavor to secure improved and better relationship
between employers and workers;
(p) to promote and protect the interest of the affiliated
units and endeavor to secure legislative support for
furthering the interests of the workers;
(q) to work for abolition of contract labour in all
its forms;
(r) to help and guide the working men and women particularly
the rural peasants to organize themselves into trade
unions and rural workers organizations for promotion
and protection of their rights, and also work for the
introduction of land reforms as well as abolition of
feudalism;
(s) to encourage and promote cooperatives and socio-economic
projects and services for the benefit of its affiliates
and their members;
(t) to promote literacy and skills amongst the workers
through:
i. adult education
ii. universal and free secondary education, vocational
training and technical education;
(u) to work for rapid industrialization of the country;
(v) to seek for a social and policy dialogue to reflect
trade union perspective in the formulation of socio-economic
policies and plans of the government in order to ensure
sustainable and equitable development;
(w) to encourage, promote and provide trade union education
for awareness raising amongst the workers, organizing
the unorganized and development of the affiliated;
(x) to seek ratification and enforcement of all ILO
Conventions especially the Core Labour Standards;
(y) to endeavor to have 40 hour week norm for workers
without reduction in wages;
(z) to promote, protect and defend all human rights
and to establish and promote cooperation with like minded
organizations of civil society for protection and advancement
of all basic rights;
(aa) to endeavor for the establishment of rule of law,
independence of judiciary and good governance.
CLAUSE: 4 MEMBERSHIPS.
A. Until otherwise decided by the G.F.T.U the membership
of the G.F.T.U shall remain limited to the provincial
constituent Industry wise union / Govt employees unions.
B. The list of the membership of the affiliates will
be kept and the members of CEC can inspect list of members
by giving one week notice to the Secretary General.
CLAUSE: 5 RESERVED SUBJECTS
The following subject shall be reserved and are hereby
reserved to be exclusively dealt with by the G.F.T.U.
A. Making and finalizing of all policy decisions in
respect of subjects and matters of both National and
International importance and directly or indirectly
affecting the workers as a whole.
B. Selection of workers representation of Pakistan
to all national and International Organizations Conferences,
Seminars and Congress meetings etc.
C. International co-operation and affiliations.
D. Ordering and withdrawing of any National strike
or stoppage of work and. Any other matter or matters
voluntarily referred to the G.F.T.U for decisions and
disposals by the constituent union and workers and govt
employees unions or any of them.
CLAUSE: 6 MEMBERSHIP FEE.
A. Members shall pay monthly subscription latest 20th
day of the following month at the following rates: -
MEMBERSHIP SUBSCRIPTION.
1 to 200 RS: 5 per member per year.
201 to 500 RS. 10 Per member per year.
501 to 1000 RS.15 per member per year.
Note: Membership of a union will be the same for the
purpose of subscription as it receives monthly Union
subscription from its members.
B. Notwithstanding sub-clause (A) above, the CEC on
receipt of a written request from an affiliate may extend
the period for payment of subscription. Where the membership
of a unit is more than five hundreds the Central Executive
Committee authorized to give concession with the prior
approval of the President and Secretary General.
C. If a member fails to pay its monthly subscription
within the prescribed period or extension granted under
sub-section (B) above should not be entitled to vote
at the General Council Session and / or seek any of
the office until such time the outstanding subscription
is paid at a stitch.
CLAUSE: 7 AUTONOMY OF CONSTITUENT UNION.
Subject to the above article and such other standing
decisions as may be made by the G.F.T.U from time to
time, the constituent union and employees union shall
be at full liberty and provincial autonomy to manage
and conduct their respective affairs, as they may deem
fit and necessary from time to time.
CLAUSE: 8 CENTRAL EXECUTIVE COMMITTEE.
A: All the powers and authority of the G.F.T.U shall
be and are hereby vested in a Committee to be known
as the "CENTRAL EXECUTIVE COMMITTEE" or "CEC"
in short. The CEC shall be the central Body / Committee
of the GFTU.
B: The CEC shall consist of 15 members to be elected
by the constituent union and workers and govt employees
unions. The office bearers the union "G.F.T.U shall
as include in the 15 members of the CEC.
C: The term of the members of CEC (Central Executive
Committee) shall not exceed three years. The Secretary
General of the G.F.T.U in close consultation with the
President shall fix a date for holding of elections
for the CEC and shall notify the same to the constituent
union and workers and govt employees (industry-wise
unions). Two months before the expiry of the term of
the existing CEC members along with issuance of Notification
for election. The President of G.F.T.U shall distribute
the seat pertaining to each union and employees (industry-wise)
unions affiliated with the G.F.T.U and shall notify
the same under registered cover to the registrar of
employees (industry-wise) as well as to all the concerned
Union in respect of each province.
D: The constituent union and employees (industry-wise)
Unions affiliated with G.F.T.U shall frame rules or
by-laws and provide the same in their respective constitutions
for the purpose of holding and conducting elections
to the ECE of the G.F.T.U according to the quota allotted
to them by the President in accordance with sub-article
- 9 (C).
E: The quorum of the meeting of CEC shall be ¾
of the total members of CEC members and no decision
of the CEC shall become effective or operative unless
the same is carried or taken by at least 2/3 majority
of the total regular members present. It shall be open
and within the right of every regular member of the
CEC to vote by proxy.
Provided however, that no such proxy shall be recognized
unless it is sued in favor of duly elected regular member
of CEC representing constituent union and teachers and
education employees (industry-wise) unions concerned,
proxy votes to cast proxy votes in addition to his or
her individual vote.
F: In case of difficulty it shall also be open to the
President to obtain opinion of the members of the CEC
by circulation of propose- able by registered post and
the opinion obtained by circulation shall be compiled
by the Secretary General and the majority opinions will
be taken as standing decision of the meeting of CEC,
in this respect the President decision will be the final
decision.
G: All meetings of CEC shall be called by the Secretary
General at such place and time as be decided the President
and Secretary General from time to time. Thirty days
clear notice shall be given for all meetings of the
CEC. In case of emergency, the President is authorized
and has the power to call a meeting of the CEC with
seven days clear notice in consultation with the Secretary
General of the G.F.T.U. At least one meeting of the
CEC shall be held in each calendar year.
H: A meeting of the CEC shall be called by the President,
if and when requested to do so in writing by at least
twenty members of the CEC within a period of 60 days
after the receipt of such requisition shall indicate
the agenda to be placed before such a meeting.
I: In case the President fails to convene a meeting
of CEC within 60 days period after the service of requisition
notice upon the President the requisiteness themselves
shall authorize on of them to convene a meeting and
issue fifteen (15) clear days notice giving date time
and place of requisitioned meeting. The agenda of such
a meeting shall remain confined to the agenda mentioned
in the requisitioned notice and in case the quorum of
requisitioned meeting is not completed within one hour
of the fixed time and date, the meeting shall be considered
to have failed.
J: The agenda of all meetings of CEC shall be fixed
by the President in consultation with the Secretary
General. If any member of the CEC violates any provision
of the constitution, the CEC can impose fine with the
approval of the President which is not exceeding five
hundreds rupees. The president can suspend his membership
or may expel from G.F.T.U.
K: The President have power to appoint special committee
or committee for special purposes and delegates to such
committee or committees such of power and responsibilities
as it may consider necessary and expedient from time
to time with the consultation of the CEC or Secretary
General.
CLAUSE: 9 INTERNATIONAL CO-OPERATIONS AND AFFILIATION.
It is being one of the main objects of the G.F.T.U to
strengthen international solidarity and actively co-operate
with workers of others countries particularly in defense
of fundamental and democratic rights and common interests,
The President and Secretary General of G.F.T.U shall
have the powers to affiliate the G.F.T.U or otherwise
co-operate with any international or national organization
of workers and withdrawal and such affiliation as it
may consider necessary and appreciate from time to time.
CLAUSE: 10 OFFICE BEARERS AND THEIR ELECTIONS.
A. The executive functions of the G.F.T.U shall be carried
out by an executive council consisting of fifteen office
bearers as under: -

B: The term of the office bearers of the Executive
Committee shall not exceed from three years. When the
election of the CEC will be completed according to Article
- 8 (C) the Secretary General in consultations with
the President of the "G.F.T.U shall chalk out a
program for election of the executive committee. The
entire proceeding of election shall be completed within
two months of the completion of the election of the
CEC. The elections to the executive committee shall
be held in a meeting of the CEC through secret ballot.
Only members of the CEC shall be eligible to contest
the elections for the Executive Committee.
C: The meeting of the Executive Committee shall be
held at least once in three months. The quorum for the
meeting of the executive committee shall be ¾
of the total number of members of the executive committee.
D: At least fifteen clear days notice giving date,
time and place along with agenda shall be necessary
for such meeting of the executive committee, in case
emergency, seven days notice shall be sufficient.
E: The numbers of the outsider office bearer will be
in accordance with the provision of IRO 1969 and IR0
1974 and IRO 2002 i.e. 25% of the total office bearers.
CLAUSE: 11 POWERS AND DUTIES OF THE OFFICE BEARERS.
PRESIDENT:
1: The President will be the Chief Executive of the
G.F.T.U to preside over all the meetings of the union,
guide and supervise the activities of the union and
be responsible for its smooth running and exercise his
discretion in case of a tie in voting and give his casting
vote.
2: President has power to nominate and recommend any
its member / office bearer of G.F.T.U to participate
in either in the country or abroad.
3: President shall direct to the Secretary General to
attend to all office correspondence promptly and matters
of high importance and policy matters in the country
and abroad according to the instruction of the President.
4: President can remove / suspend any office bearer
of CEC due to any illegal activities, which found against
G.F.T.U or union constitution or neglect the directions
of the president. The approval will be taken from the
CEC within 15 days.
5: President cancelled / closed the function or any
other process of the federation and affiliated union
which will against law and order.
6: President shall nominate 10 members for CEC from
the office bearers of the affiliated union / industry-wise
unions.
7: President will be authorized that he gives directions
/ instructions to any Deputy General Secretary, Assistant
General Secretary, Joint Secretary, Secretary International
Relations or any other office bearer for correspondence
in country or abroad with the consultation of Secretary
General.
8: President is fully authorized to given affiliation
to any registered / un- registered federation or industry-wise
unions with the consultation of Secretary General.
SENIOR VICE PRESIDENT:
He shall generally assist and help the President in
the performance of his duties. In the absence of the
President the senior vice-President shall preside over
the meetings
VICE PRESIDENT:
Vice President shall assist the Senior Vice President
in his functions and preside over the meetings of the
union in the absence of both President and Senior Vice
President.
SECRETARY GENERAL:
1: Secretary General is responsible for the proper execution
of the direction issued and resolution passed at the
meeting of the union as well as directed by the President.
2: Secretary General will attend to all correspondence
and also he will be authorized to make any correspondence
within the country or abroad with the consultation of
the president.
3: Secretary General convenes meetings and duly recorded
their proceeding as per ad vice of the President.
4: Secretary General will attend to all such matters
as are entrusted to him by the president and CEC.
5: Secretary General will operate the union account
in any scheduled bank with the collaboration of the
treasury of the union.
DEPUTY SECRETARY GENERAL:
He shall generally assist and help the Secretary General
in performance of his duties. In the absence of the
Secretary General the Deputy General Secretary shall
perform the duties of the Secretary General.
ASSISTANT GENERAL SECRETARY.
He shall generally assist and help the Secretary General
and Deputy Secretary-General in performance of their
duties. In the absence of the Secretary General or Deputy
Secretary-General the Assistant General Secretary shall
perform the duties of the Secretary General or Deputy
Secretary-General with the written orders of the President
of union.
JOINT SECRETARY.
They shall do the help of the Secretary General to maintain
the office record and prepare the register of membership
and also they found helpful for the President and Deputy
Secretary-General.
TREASURER.
He will be responsible for the account matters and also
he will maintain the register of income and expenditure
of the union. After the completion of a year, he will
produce the total account record to the President &
Secretary General of the union.
B: He shall authorize to draw the cash from the scheduled
Bank with the signature of the Secretary General and
his own signatures.
C: The treasurer is fully responsible for the any loss
in the union account.
D: He shall collect the funds from the affiliated union
and Industry-wise unions.
OFFICE SECRETARY:
He shall generally perform their duty under the supervision
of the President & Secretary General.
B: He shall perform the duty as office secretary and
also he shall be responsible for the office record and
office mail.
SECRETARY INTERNATIONAL RELATIONS:
He shall perform the duties of friendly relations with
other union & Industry-wise Unions in Country as
well as abroad, under the directions of President &
Secretary General.
B: He will be fully authorized with the written orders
of the union President to made correspondence at international
level with labour organizations.
ORGANISING SECRETARY:
He shall perform the duties to organize the union functions
/ Districts / Province and national level according
to the instructions of the President & Secretary
General of the union.
WORKERS EDUCATION SECRETARY:
He shall chalk out the programs for workers education
in shape of Seminars / Meetings / Debates to the instructions
of the President and Secretary General of the union.
INFORMATION SECRETARY:
He shall perform the duties as Secretary Information;
he shall keep information regarding the union activities.
B: He shall make close relations with the Newspapers
and electronic media for the publicity of the union
activities.
CLAUSE: 12 AMENDMENT OF THE CONSTITUTION.
The constitution may be amended by the CEC duly assembled
in a meeting provided the notice containing the proposed
amendment or has been received and circulated by the
Secretary General with the prior permission of the President
at least three months before the date of meeting concerned.
The decision for amendments or amendments shall be approved
by ¾ majorities of the members of CEC, present
in the meeting called for the purpose. The quorum for
the meeting shall be 75 % voting by proxy shall be permissible.
CLAUSE: 13 AUDITORS.
The accounts of the union shall be audited by one or
more auditors appointed by the executive committee with
the consultation of the President. Annual meeting in
accordance with the law applicable to the Unions such
auditor shall not be members of the executive committee.
CLAUSE: 14 FUNDS.
The union shall raise funds by admission fee subscriptions,
donations and any other means not contrary to law clauses
of the constitution,
A: These funds may be utilized for:
i) Organization expresses and cost of management of
the union.
ii) Propaganda and other activities undertaken by the
union.
iii) Relief of needy and distresses members or their
members and / or their dependents.
iv) Compensation to any member of the union or their
member whose interests have been damaged by reason of
their service to the union.
v) Purchasing of land and buildings or any their assets
for use of the union and in further of its objects.
vi) Such other purpose within the aim and object of
the union as may be decided by the CEC.
B: Funds when not in use shall be deposited within 48
hours of receipt (Bank holidays not being counted) in
a bank or otherwise invested in Government Securities
as decided by the CEC except that Rs. 500/- in cash
may be retained by the Treasurer for emergency / miscellaneous
expenses.
C: Funds when deposited in a bank the account shall
be opened in the name General Federation of Trade Unions
(GFTU) and account shall operate under the joint signatures
of the following two office bearers: -
1: Secretary General
2: Treasurer (Finance Secretary).
CLAUSE: 15 VOTE OF NO CONFIDENCE.
If any time votes of no confidence raised against any
office bearer of the union except the President, the
75 % votes shall be considered success and for against
the President majority of the quorum ¾, if cast
the no confidence vote against the CEC than that will
be passed in the General Council.
CLAUSE: 16 DISSOLUTION.
PSU may be dissolved if majority votes of 75 % of the
CEC member's present and voting favour the dissolution.
No proxy vote shall be allowed for the purpose of the
dissolution.
The assets and liabilities of the G.F.T.U shall be distributed
amongst the constituent union and industry-wise unions
in accordance with their share of payment fixed in the
constitution or all the assts will be donated to any
good reputed NGO / institution.
CLAUSE: 17 MISCELLANEOUS.
A. Notwithstanding anything contained to the contrary
in the constitution every retiring member of the CEC
(including the office bearers) shall be always eligible
for re-election to the CEC and the office of the union.
B. The CEC shall have the power to issue a ruling on
any point or points on which this constitution is silent
and such ruling if not in contradiction with the provision
of the IRO 1969 shall have the same force as if it is
ware a duly enacted part of the constitution.
C. The executive committee shall include not less than
75 % from amongst the workmen actually engaged or employed
in any establishment or industry situated in Pakistan.
